Medical Travel Companions Pty Ltd (MTC)
Standard Terms & Conditions plus each job has additional Terms & Conditions
1. Services Provided
Any quotation invoice issued by Medical Travel Companions Pty Ltd (MTC) is valid for 30 days from the date of issue unless accepted earlier. Unless otherwise stated, all prices are exclusive of GST.
Once a quote has been accepted, no cancellation, amendment or variation will be effective unless agreed to in writing by MTC. Cancellation fees are outlined in Clause 3.
MTC and any contracted partners takes no clinical liability or any other liability for the services provided.
2. Billing Arrangements
MTC will provide the client with a quote outlining all charges for the client’s services. MTC will issue an invoice to the client if accepted and all payments are upfront before the service is provided. The Agent must pay all invoices within the agreed payment terms stated on the invoice.
3. Cancellation of Travel and Fees
Cancellation More Than 14 Days Before Travel
If the Client cancels the service more than 14 days before the scheduled start date, the Client will be responsible for 60% of the quoted service fees. If full payment has already been made, MTC will refund the remaining 40% within seven (7) days of receiving written notice of cancellation.
Cancellation Within 14 Days of Travel
If the Client cancels within 14 days of the scheduled travel date, 100% of the quoted service fees are payable. No refund will be provided for cancellations made within 14 days of departure.
Expenses
If the Client has prepaid expenses, MTC will:
- Refund part expenses that have not been paid or committed; this does not include companion costs and
- Refund any recoverable amounts from third-party suppliers where MTC can obtain a refund.
Events Outside Our Control
MTC is not responsible for delays or service disruptions caused by circumstances beyond our reasonable control, including but not limited to:
- Flight, Travel delays or cancellations
- Missed connections
- Natural disasters
- Terrorist events, war
- Government restrictions
- Other unforeseen travel disruptions
- Other unforeseen issues with the companion or MTC services
Where services are extended because of such events, agreed daily rates and additional expenses will
apply at standard rates.
Failure to Comply
If the Client fails to comply with these Terms and Conditions, MTC may:
- Suspend services and abort the job or mission;
- Adjust the service schedule;
- Invoice for services already provided; and
- Recover any additional costs or losses caused by the Client’s actions.
4. Payment for Services
Payment may be made directly to MTC or through an Agent, as agreed.
Invoices must be paid in accordance with the payment terms stated on the invoice (upfront) and/or specific Terms & Conditions sent to the client.
If payment is not made by the due date, interest may be charged on the overdue amount at a rate equal to 8% above MTC’s bank overdraft rate until payment is received in full or MTC will cancel the job altogether.
5. Changes to Services
If the Client requests additional or alternative services, MTC is not required to provide them unless agreed in writing.
Where additional changes are requested by either MTC or the Client, MTC will provide a revised written quote detailing:
- The proposed changes;
- Any additional costs; and
- Any revised terms.
No variation will take effect until agreed by all parties.
6. Confidentiality and Privacy
MTC, Contractors and its Clients or Agents will keep all Client information confidential, including health and personal information. Information will only be used or disclosed where reasonably necessary to provide the agreed services or where required by law. MTC holds no liability for any actions by MTC and/or its contractors.
7. Travel Insurance and Liability
MTC provides a companion service only and does not provide medical treatment, medical advice, nursing services or clinical care unless expressly agreed in writing.
Clients are strongly encouraged to obtain appropriate travel insurance before travelling.
Clients must be declared as “fit for travel” and are responsible for obtaining any required medical clearances. To the extent permitted by Australian law, MTC is not responsible for losses, injuries, death or damages suffered during its assignment and/or travel.
8. Incapacity of a Travel Companion
If the nominated travel companion becomes unable to provide services due to illness, injury or other unforeseen circumstances, MTC will make reasonable efforts to arrange a suitable replacement. This may incur additional charges to the client. If a replacement cannot be arranged, MTC will assist the Client in identifying alternative support where practical.
Any additional third-party costs incurred may be the responsibility of the Client.
9. Warranties and Limitation of Liability
MTC will provide services with reasonable care and skill consistent with accepted professional standards. Except for rights that cannot legally be excluded, all other warranties are excluded. MTC is not liable for any actions by MTC and/or Contractors.
Where MTC is liable for a claim, MTC’s liability is nil and limited to either:
- Re-supplying the relevant service at the client’s expense; or
- Client paying the full cost the MTC of having the service supplied again.
To the maximum extent permitted by law, MTC’s total liability will be nil not exceed the amount paid to MTC for the services giving rise to the claim.
MTC will not be liable for any direct or indirect, consequential or special losses, including loss of income, profits, savings or business opportunities.
10. Default
If either party breaches these Terms and Conditions, MTC may issue a written notice requiring the breach to be remedied. If the breach is not remedied within fourteen (14) days, the non-defaulting party may terminate the services agreement by written notice.
11. General Terms
The Client must not transfer or assign any rights or obligations under these Terms and Conditions without MTC’s prior written consent. Any waiver of rights must be in writing.
If any provision of these Terms and Conditions is found to be unenforceable, the remainder of the Terms and Conditions will remain in full force and effect.
These Terms and Conditions are governed by the laws of Australia and apply globally, and the parties submit to the jurisdiction of the relevant Australian courts
